Terms And Conditions
Thank you for expressing interest in Prime Tuition. We seek to provide our services to both our tutors and clients to the best of our ability, subject to the following terms and conditions.
1.0 For Tutors
1.1 Registration Requirements
a. You affirm that all information provided by you upon registration is true and accurate.
b. You are at least 17 years of age at the point of registration and have attained a minimum GCE “O” Level pass or its equivalent.
c. You may indicate the subjects you wish to teach. However, the Prime Tuition reserves the right to determine the subjects you may actually undertake for tutoring at its sole discretion.
d. You possess one of the following 1. Citizenship; 2. Permanent Residency; 3. Valid Employment Pass conferred by the Republic of Singapore.
e. Your education qualifications are to be verified by a staff before the commencement of your first assignment. Prime Tuition reserves the right to replace any tutor who does not comply with this condition.
f. Prime Tuition reserves its rights to reject an application subjected, but not limited to, the following conditions.
- Incomplete Registration;
- Insufficient Details;
- Dubious Information Entry;
- Fictitious Experience Claims
1.2 Confirmation of Assignment
a. Confirmation of your assignment will be indicated by the Company through verbal communication. Thereafter, you are subject to the terms and conditions in this section.
b. Upon confirmation of your assignment, you are expected to fulfil the capacity of a Tutor to the best of your ability and commit to the agreed term (*1).
c. Once your assignment is confirmed, you must commence tuition within a month and complete at least 1 term (*1), unless otherwise informed by the Company or the Client. In the event that you violate this agreement 1.2c, you are liable to pay the Company a $50 administrative charge and the Client any compensation the Company deems fair.
d. The fees will be based on tuition rates agreed upon at the point of confirmation between the Tutor and the Company.
e. As the Tutor is providing private tuition service under a contract of service to the Client as an independent contractor, he or she is personally responsible for all necessary registrations with the Central Provident Fund as a self-employed person.
f. All Tutors who are school teachers are expected to obtain the necessary approval from the Ministry of Education before accepting any assignment from the Company.
h. A Client Satisfaction Survey (*2) will be conducted by the Company with the Client after the completion of the first term (*1) as part of our quality management framework.
2.0 For Clients
a. The Company seeks to be error-free in the information it provides and to assign the most suitable tutor to you (‘The Client’). However, the Company does not ensure the complete accuracy of information collected from the tutors.
b. You reserve the right to terminate the services of the assigned Tutor at any point in time.
c. You reserve the right to verify, through the inspection of original education certificates, the academic credentials of the Tutor(s). The Company will try within its best efforts to verify the relevant documents before the commencement of the assignment. However, the Company bears no responsibility should the Tutor falsify his or her academic qualifications.
d. The termination is, however, subjected to the termination policy as detailed in Section 4.2.
2.1 Payment Details
a. The Client will pay the tuition fees for the first half of the first term (*1) of tuition to the Company.
b. The Client will pay subsequent tuition fees (other than the portion mentioned in 2.1a) to the tutor directly.
c. The fees will be based on tuition rates agreed upon at the point of confirmation between the Client and the Company.
d. Payment methods must fall under the forms of payment listed – 1. Cash; 2. Cheque; 3. Bank Funds Transfer.
3.0 General
a. The default venue of tuition is the students’ place of residence, unless otherwise agreed upon by the Client, the Tutor and the Company.
b. The Tutor is required to bring along all documents verifying his or her identity and academic qualifications for the first lesson. The Client is advised to verify the tutor’s identity and credentials before the official commencement of the assignment.
c. An interview can be arranged upon the request of the Client and the Tutor is obliged to attend any scheduled interview. The Company reserves the right to collect an administrative fee for arranging the interview.
d. For the first term (*1) of the assignment, all fees will be fixed upon confirmation of assignment. Both the Tutor and the Client are not allowed to negotiate or amend the tuition fees as fixed with the Company.
e. In the cases whereby disputes arise, the Company is not obliged to intervene. However, the Company may arrange a change of tutors as an act of goodwill. As such, a new contract of service with the replacement Tutor will be negotiated.
3.1 Commission Structure
a. The Company will collect a commission of 50% of the fees for the first term (*1) for each successful assignment.
3.2 Termination Policy
a. If the Tutor terminates the assignment within a term (*1), the Company will retain all fees collected as administrative charges.
b. If the Client terminates the assignment within a term (*1) with a valid reason, the Tutor will not receive any portion of the fees collected for the number of lessons completed. The Company will retain the full fees as administrative charges.
c. If the Client terminates the assignment within a term (*1) without a valid reason, the Company will only retain 10% of the fees collected for the number of lessons completed as administrative charge. The Tutor will receive the remaining 90% as payment for the assignment.
d. The validity of reason given is decided solely by the Company. In the case that the validity of the given reason cannot be established, the Tutor will receive 75% of the fees collected for the number of lessons completed. The Company will retain the 25% of fees as administrative charges.
d. Under any termination circumstances, the Client is required to pay for the number of lessons conducted by the Tutor.
*1 – a “term” refers to a month or a time period in which an equivalent number of lessons is completed. For example – the Client forms agreement with the Tutor to conduct 4 lessons per month. Due to unforeseen circumstances, the initial 4 lessons take place over an extended period of 1.5 months. The “term” in this scenario is 1.5 months.
*2 – a Client Satisfactory Survey will be conducted upon completion of the first term and will be used to evaluate the performance of the Tutor. The amount of the variable component awarded to the Tutor will depend on this evaluation.
